Ignited Ideas, the owners and creators of AHigherThoughts Video eCard (VideoCard) platform (hereafter referred to as “AHigherThought”) grant you a limited license to use the services provided by solely for your personal use, subject to these Terms of Use. No other use of the website is authorized. You agree that any copy of the materials (or any portion of the materials) that you make shall retain all copyright and other proprietary notices contained herein or therein. Embedding of the website or site materials or posting of materials on other websites outside of these Terms of Use is prohibited.

These terms of use apply to your use of all of the Sites and services owned, hosted, or operated by AHigherThought (collectively “we,” “us,” or “our”), including, do own and operate or may own or operate in the future including social media sites (collectively, the “Sites”). We understand that many people may have differing opinions on what constitutes inappropriate content, so please be sure to read the following information to understand what AHigherThought deems as inappropriate.

For each message we consider the written message of the VideoCard as well as any attached photos, videos or graphics itself. If there’s a question about whether something’s appropriate for our user community, we’ll err on the side of removing the personalized VideoCard from circulation.

Please note AHigherThought reserves the right to investigate reports of misuse of its service and to protect its property and assets reserves the right to remove any personalized VideoCard from circulation for any reason, including if we think it goes against any of these rules or our Terms of Use.

What You Can't Send

You aren’t allowed to send anything that:

  • Is sexually suggestive including nudity, partial nudity, lingerie or bathing suit photos
  • Is sexually explicit or pornographic, exploits or presents anyone in a sexual way, or promotes adult sexual services 
  • Creates a genuine risk of physical injury or property damage, credibly threatens people or public safety, or organizes, encourages or celebrates harm 
  • Promotes self-harm, eating disorders or hard drug abuse 
  • Attacks, bullies or harasses people, including harrasment in the form of proselytizing religion or politics
  • Includes lude comments or hate speech 
  • Is gratuitously violent or gory 
  • Infringes anyone's intellectual property, privacy or other rights 
  • Is fraudulent or deceptive 
  • Is someone else's personal information or requests a minor's personal information 
  • Contains any information or content that’s illegal 

You are not allowed to:

  • Send unsolicited emails (spam) to anyone whom you do not have a personal or business relationship with or who not has opted in to receive communication from you. This includes the procurement, purchase or rental of any email lists.
  • Use AHigherThought's name, logo, trademark or branding without our consent
  • Access, tamper with or use non-public areas of AHigherThought, our systems or our technical providers’ systems
  • Attempt to steal passwords, break or circumvent our security measures or otherwise test the vulnerability of our systems or networks
  • Use any method to access, search, scrape, download or change
  • Use meta tags, hidden text or metadata with our trademark, logo, URL or product name without our written consent
  • Try to reverse engineer any of AHigherThought’s software
  • Try to interfere with any user, host or network of AHigherThought, for example by sending a virus, overloading, spamming or mail-bombing
  • Collect or store personally identifiable information from AHigherThought or its users without their permission
  • Impersonate or misrepresent your affiliation with any person or entity
  • Do anything that violates applicable law or regulations
  • Share your password, let anyone access your account or do anything that might put your account at risk
  • Sell your username or otherwise transfer it for compensation
  • Create or show ads that look like or could be confused with AHigherThought's content
  • Directly compensate users for sending AHigherThought
  • Encourage or help anyone do any of the things on this list

Violations of AHigherThought’s Acceptable Use Policy will result in the sender being blocked from sending additional VideoCards from the site. AHigherThought reserves the right to disclose to third parties, their counsel, and/or law enforcement authorities, all relevant information about a communication.

Spam Policy

You may NOT use AHigherThought to send VideoCards to mailing lists to which you do not have full rights or to send unsolicited bulk personal or commercial messages. Send unsolicited emails (spam) to anyone whom you do not have a personal or business relationship with or who not has opted in to receive communication from you. This includes the procurement, purchase or rental of any email lists.

AHigherThought reserves the right to limit, in its sole discretion and without prior notice to you, the number of VideoCards or personalized messages that you may send using the site and/or the number of recipients to which you send such VideoCards or personalized messages.

You are solely responsible for your actions and communications undertaken or transmitted using Neither AHigherThought or our affiliates exercise editorial control over your transmissions; however, we do reserve the right to review your uploads and transmissions in order to ensure compliance with these Terms.

Warranty Restriction; Limitation of Liability

The materials and services provided by AHigherThought are provided as you find them without any kind of warranty. AHigherThought is not responsible for any failure of electronic messages sent through its website to any intended recipients on the date specified by the sender. The materials on the site are subject to change without notice.

Neither AHigherThought, nor any of their affiliates, vendors, employees, directors or sponsors shall be liable for any direct, indirect, or special punitive, exemplary and/or incidental damages of any kind whatsoever resulting from or arising in connection with your access to, inability to access, or use this site.

Neither AHigherThought, nor their affiliates takes any responsibility or assumes any liability for any content uploaded or otherwise transmitted by you or any third party, or for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography, indecency, lewdness, harassment, threats, abuse, or profanity you may encounter in using this site. International Use

Neither AHigherThought or their affiliates make any representation that materials on this website are appropriate or available for use in locations outside the United States, and accessing them from territories where their contents are illegal is prohibited. Rewards Program

Membership in AHigherThought’s Rewards Program is a built-in part of the AHigherThought platform. Having a valid existing user account or establishing a valid user account with AHigherThought automatically enrolls you in AHighierThought's Rewards Program. If AHigherThought determines that you have violated these Terms of Use, we reserve the right to immediately block your ability to send greetings from the site, and/or pursue any other remedies available to it under applicable law.

This agreement, and the respective rights and obligations of the parties hereto, shall be governed by and construed in accordance with the laws of the State of South Carolina. Any action of the parties shall be initiated and maintained only in a court of competent jurisdiction in South Carolina.

Copyright Claims

AHigherThought respects the intellectual property rights of others, and requests you to do the same. AHigherThought does not permit copyright infringing activities on its website or related services, and will remove all content if properly notified that such content infringes another's copyright rights. AHigherThought reserves the right to remove content and personalized VideoCards from circulation without prior notice. AHigherThought will also block any users who are determined to be repeat copyright infringers.

AHigherThought abides by the federal Digital Millennium Copyright Act (DMCA)  by responding to notices of alleged infringement that comply with the DMCA and other applicable laws. As part of our response, we may remove or disable access to material residing on a site that is controlled or operated by Ignited Ideas, Inc. that is claimed to be infringing, in which case we will make a good-faith attempt to contact the person who submitted the affected material so that they may make a counter notification, also in accordance with the DMCA.

AHigherThought does not control content hosted on third party websites, and cannot remove content from sites it does not own or control. If you are the copyright owner of content hosted on a third party site, and you have not authorized the use of your content, please contact the administrator of that website directly to have the content removed.

Before serving either a Notice of Infringing Material or Counter-Notification, you may wish to contact a lawyer to better understand your rights and obligations under the DMCA and other applicable laws. If material that you have posted to a VideoCard from has been taken down, you may file a counter-notification that contains the following details:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
  2. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material in question;
  3. Your name, address and telephone number;
  4. A statement that you consent to the jurisdiction of the Federal District Court for judicial district in which your address is located or, if your address is outside of the USA, for any judicial district in which AHigherThought may be found and that you will accept service of process from the person who submitted a notice in compliance with the section (c)(1)(C) of the DMCA, as generally described above;
  5. Your physical or electronic signature.
